🚨 REALTORS — this Chicago rule could kill an owner-occupied 2–4 unit deal. Condos too.

I recently had a buyer trying to purchase a 2–3 unit property in Chicago using owner-occupied financing.

The problem? All of the units were occupied by tenants.

Under Chicago’s Fair Notice Ordinance, a tenant who has lived in the property for more than 3 years may be entitled to 120 days’ notice before the tenancy can be terminated.

That creates a BIG problem when the buyer is using owner-occupied financing — because they generally need to occupy the property shortly after closing.

And waiting 120 days to close isn’t always as simple as it sounds. Loan documents, credit reports, income documentation and other items can expire or need to be updated.

So now you potentially have a situation where:

🏠 Buyer wants the property
💰 Buyer qualifies for owner-occupied financing
👨‍👩‍👧 Tenants have been there 3+ years
⏰ Seller may need to give 120 days’ notice
❌ Buyer can’t simply move in after closing

And this can hurt BOTH the buyer and seller.
