For years, when a homebuyer applied for a mortgage and authorized a credit pull, credit reporting agencies could sell that information to other lenders — triggering a flood of unsolicited calls, texts, and emails. Known as trigger leads, this practice is now federally banned to better protect consumer privacy and reduce unwanted solicitations.

The Homebuyers Privacy Protection Act (HPPA) amends the Fair Credit Reporting Act to limit when consumer reports can be shared in connection with mortgage applications. Moving forward, consumer reports can only be provided if the offer is a firm offer of credit or insurance and the requesting party is either the consumer’s current mortgage lender/servicer or a financial institution where the consumer already holds an account.
