🌸 Spring has sprung! But it's bringing more than just blossoms and birdsong... ā›ˆļø

Before you get too distracted by the warmer weather, here are a few gentle reminders to limit your risk:

šŸ‚ Clean your gutters: Clear out the winter debris before the first big thunderstorm. This will help you avoid leaks and keep your structure maintained.
🌳 Trees: Check for dead tree branches before the spring winds decide to drop them on your car or on your home.
šŸ”„ Prep for the braai: Check your gas connections and equipment before declaring braai season officially open.

A little spring housekeeping today can save you from major headaches tomorrow! šŸ› ļø Because let's be honest, the best insurance claim is the one you never have to submit.

We wish to bring to your attention a concerning increase in incidents involving drivers operating vehicles with fraudulent, altered, expired, suspended, or otherwise invalid driver's licences.

Recent claims investigations have identified a growing trend where inadequate controls are in place to verify the authenticity and validity of driver's licences before employees or contract drivers are authorised to operate vehicles. This exposes businesses to significant operational, legal, and financial risks.

The National Road Traffic Act, 93 of 1996, requires that drivers of motor vehicles be appropriately licensed and legally entitled to operate the class of vehicle being driven. Employers and vehicle owners who permit unlicensed or improperly licensed individuals to drive company vehicles may expose themselves to liability and regulatory consequences. [https://www.gov.za/], [https://www.saflii.org/]

In addition, organisations have a common-law duty of care to take reasonable steps to ensure the safety of employees, passengers, members of the public, and third parties who may be affected by their operations.

Emerging Claims Concerns
The consequences of allowing individuals with fraudulent or invalid licences to operate vehicles extend far beyond vehicle damage. We continue to see incidents resulting in:

•Damage to insured vehicles and company assets.
•Bodily injury to drivers, passengers, employees, and members of the public.
•Damage to third-party property.
•Increased claims costs and uninsured losses.
•Potential civil liability arising from negligent supervision or inadequate oversight.
•Reputational damage to businesses.
•Recovery challenges where responsible drivers cannot be traced.

Of particular concern are cases involving foreign nationals who have presented fraudulent driver's licences or falsified supporting documentation. Following serious accidents, some individuals have become untraceable, leaving employers exposed to significant financial and legal consequences. ļæ¼

Employer Responsibilities
Businesses that own, lease, hire, or operate vehicles should ensure that robust driver verification controls are in place before permitting any employee, contractor, temporary worker, or foreign national to operate a vehicle.

The Administrative Adjudication of Road Traffic Offences (AARTO) framework further emphasises the responsibility of vehicle owners and operators to maintain records of authorised drivers and to exercise proper oversight regarding the use of vehicles. [https://bowmanslaw.com/]

Employers cannot rely solely on the presentation of a driver's licence card as proof of validity. Reasonable verification measures should be implemented to confirm that licences are genuine, valid, and appropriate for the vehicle class being driven.

Recommended Minimum Controls
We strongly recommend that all clients implement and maintain the following controls:

1.Verify all driver's licences before employment and prior to granting driving authority.
2.Conduct periodic licence validation checks for all authorised drivers.
3.Verify the authenticity of foreign driver's licences and International Driving Permits where applicable.
4.Ensure that the licence class corresponds with the type of vehicle being operated.
5.Maintain copies of driver's licences, identity documents, work permits, and supporting records.
6.Monitor licence expiry dates and establish renewal tracking procedures.
7.Conduct regular fleet and driver compliance audits.
8.Immediately suspend driving privileges where fraudulent or questionable documentation is identified pending investigation.
9.Maintain a register of authorised drivers and ensure management oversight of vehicle allocation and driver eligibility.

Insurance and Risk Implications
The use of fraudulent, altered, expired, suspended, or otherwise invalid driver's licences may have significant implications during claims assessment and could adversely affect an insurer's ability to provide indemnity where policy conditions, legal requirements, or reasonable risk management controls have not been complied with.

Clients are therefore encouraged to review their recruitment processes, fleet management procedures, and driver verification controls as a matter of urgency.

Conclusion
The verification of driver's licences should not be regarded as a simple administrative exercise, but as a critical risk management control. Failure to implement adequate verification procedures increases the likelihood of serious accidents, injury claims, third-party liability, regulatory scrutiny, and substantial financial loss.

14/08/2026

The Insurance Crime Bureau (ICB) has recently issued an industry alert regarding a surge in the theft of new-model, high-end SUVs through the use of relay attack technology. According to the ICB, there has been a noticeable increase in these incidents, particularly in the Bloemfontein area, with organised criminal groups targeting vehicles fitted with keyless entry and keyless start systems.

Understanding Relay Attacks
Relay attacks enable criminals to electronically intercept and amplify the signal emitted by a vehicle's key fob, allowing them to unlock, start and steal a vehicle without having physical possession of the key.

The typical modus operandi involves:

• A suspect positioning themselves close to the vehicle owner.
• Specialised equipment capturing the signal from the key fob.
• The signal being relayed to an accomplice near the vehicle.
• The vehicle being unlocked, started and driven away.

What This Means for you
As trusted insurance advisors, brokers play an important role in helping clients understand emerging risks and take preventative action. We share the following recommendations with clients who own vehicles equipped with keyless entry systems:

āœ” Store vehicle keys away from doors, windows and other easily accessible locations.
āœ” Consider using a Faraday pouch or signal-blocking key storage solution.
āœ” Park vehicles in secure, well-lit areas whenever possible.
āœ” Activate all available vehicle security features.
āœ” Remain vigilant when in public areas, particularly when carrying vehicle keys.

These recommendations constitute general risk management guidance only. They do not amend, vary or override the terms, conditions or exclusions of any insurance policy and do not replace any tracking, vehicle security or other requirements applicable to the insured vehicle.

The original industry alert, titled "Surge In High-End SUV Thefts Using Relay Attacks", was issued by the Insurance Crime Bureau and highlights the increasing use of this theft method against newer vehicles that rely on proximity-based keyless entry and ignition systems.

Thanks to global part shortages, vehicle repairs are taking way longer than usual right now. Because of this, we’re seeing a lot of clients run out of their rental car days while they wait for their cars to be fixed.

The tough part? Insurers can't just extend your car hire cover beyond the days you’ve already selected in your policy. Once those days are up, they're up.
