NATIONAL CALL TO ACTION
PROFESSIONAL BAIL AGENTS OF THE UNITED STATES (PBUS)
Indiana and Tennessee Constitutional Amendments
November 3, 2026
On November 3, voters in Indiana and Tennessee will decide on constitutional amendments that would expand the authority of courts to deny bail before trial. These proposals have significant implications for constitutional rights, public safety, and professional surety bail throughout the United States.
This is a national issue requiring the attention of professional bail agents in all 50 states. Indiana's Public Question 1 and Tennessee's Amendment 1 take different approaches, but both would change longstanding constitutional protections governing pretrial release.
PBUS encourages every professional bail agent to become informed about these proposals and participate in constructive public discussion. Agents in Indiana and Tennessee can help their communities understand the amendments, while agents nationwide can share accurate information with relatives, colleagues, and other contacts in those states.
Pick up the telephone. Visit with people. Discuss the issues at church, in your community, and with those who have questions about professional surety bail. Explain the accountability our profession provides and why constitutional changes deserve careful consideration.
These elections may influence future legislative discussions in other states. Our profession has an opportunity to demonstrate national unity, professional knowledge, and responsible civic leadership.
For information, educational resources, or coordination, contact your state bail association leadership or PBUS.
