Understanding Debt Collectors: What You Need to Know! 📞💼

Debt collectors play a significant role in the credit system, but it's crucial to understand their practices and your rights. Here are the essential facts you should know:

🔹 What They Do: Debt collectors are hired by creditors to recover overdue payments. They may also purchase debts and seek to collect the full amount from you.

🔹 Legal Guidelines: In South Africa, debt collectors must adhere to the National Credit Act and the Debt Collectors Act. While most operate within these guidelines, aggressive behavior such as intimidation or abusive language is unacceptable. They must remain professional and respectful at all times.

🔹 Your Rights: You have rights when dealing with debt collectors:

• Request written validation of the debt.
• Dispute any inaccuracies.
• Protect yourself from threats or intimidation.

🔹 Impact on Credit Score: Unpaid debts in collections can harm your credit score, making it harder to secure loans or credit in the future.

🔹 Finding Solutions: If you’re struggling with debt, consider options like debt review or credit counselling. These can help you manage payments and avoid the stress of collections.

Stay informed and assertive! If you feel threatened or intimidated by a debt collector, seek advice and know that you don’t have to tolerate illegal practices.

What is a Garnishee Order? 🤔💼

A Garnishee Order, also known as an Emolument Attachment Order, is a court-issued instruction sent to your employer. It requires them to deduct money from your salary before it reaches your bank account, directing the payment to settle a debt owed to a creditor. 🏦 This deduction continues until the debt is fully repaid.

💡 How can you avoid Garnishee Orders?

By acting early! If your monthly debt installments are more than your income and you're struggling to keep up with payments, consider entering Debt Review. This process can help you restructure your debt into more manageable payments, protecting your salary from garnishee orders and other legal actions. ⚖️ Don’t wait until creditors act—take control before it's too late.

What Happens If Creditors Take Legal Action? 🛑

As a consumer, it's crucial to understand what happens if you fall behind on payments and creditors take legal action. Here’s a breakdown:

1. Section 129 Notice 📬: Before legal action, creditors must send you a Section 129 notice. This gives you 10 working days to resolve the issue, negotiate repayment terms, or apply for Debt Review. Don’t ignore it!

2. Letter of Demand 📄: A formal demand for payment will follow, giving you time to settle before further action.

3. Summons ⚖️: If the debt remains unpaid, you’ll receive a summons, which means the creditor is taking you to court. It’s important to respond or get legal advice!

4. Default Judgment 🏛️: If no defense is made, creditors can apply for a default judgment in their favor.

5. Warrant of Ex*****on 💼: The final step could involve attaching your assets or garnishing wages to recover the debt.

⚠️ If you’re under Debt Review, this process can be halted, ensuring legal protection. Act fast and seek advice from a registered Debt Counsellor if you’re struggling with debt.

📝 FAQ: Can I Pay More Than the Quoted Amount Under Debt Review?

💡 Answer: Yes, you absolutely can! Paying more than the agreed-upon amount when your salary increases is a smart way to reduce the time you spend under Debt Review. Here's what you need to know:

• Shorten Your Debt Review Period: Extra payments help settle your debts faster, meaning you could complete the process sooner than expected.

• Target Specific Debts: You can choose which creditor(s) you want to allocate the extra payments to. Just let your Debt Counsellor know, and they’ll adjust your repayment plan accordingly.

• Settle Accounts in Full: If you have enough funds, you can even fully settle one or more accounts. Your Debt Counsellor can provide up-to-date balances to help with this.

• No Penalties: There are no penalties for paying more, so it’s all about speeding up your path to financial freedom!

Taking control of your repayments can give you peace of mind and help you exit Debt Review faster than anticipated. With Rossouw Debt Counsellors, you can build a brighter future by taking proactive steps towards financial freedom. Chat with us if you have any questions or need assistance with the process!

What is the process for applying for Debt Review? 🤔

1️⃣ Step 1: Consultation
Reach out to a registered Debt Counsellor (like Rossouw Debt Counsellors NCRDC3032 😉). We’ll review your financial situation and check if you qualify.

2️⃣ Step 2: Application
If eligible, you’ll complete an application (Form 16), which must be accompanied by your latest payslip and a copy of your ID.

3️⃣ Step 3: Notification to Credit Providers
We’ll notify your creditors that you’ve applied for Debt Review, and they’ll provide us with Certificates of Balances (COBs).

4️⃣ Step 4: Payment Plan
We’ll negotiate a restructured payment plan (proposal) aimed at making your monthly payments more manageable, including reduced monthly installments and extended terms.

5️⃣ Step 5: Legal Protection
Once the plan is finalized, it gets sent to court for approval, protecting you from legal action from creditors.

6️⃣ Step 6: Pay & Relax
Start making one consolidated monthly payment, and we’ll distribute it to your creditors. Monthly statements will be sent to keep you updated on your progress. It’s crucial to maintain your reduced monthly installment and avoid any defaults or partial payments throughout the entire process for a smooth sailing experience.

7️⃣ Step 7: Completion & Clearance
Once all debt is settled in full, a Certified Clearance Certificate will be issued to all registered credit bureaus and listed credit providers, removing you from Debt Review and allowing you to incur further debt should the need arise.

✅ Debt Review helps you take control of your debt in a structured and legal way.
