Looking forward to a second meeting with a lovely couple tomorrow. Delivering and explaining the content of their Wills and LPAs, including a Severance of Joint Tenancy (Land Registry) to match a Protective Property/Right to Reside Trust which will keep the family home outside of Care Home fee assessment. My personal view is that if you've worked and paid all your taxes for 40+ years, your home should be immune to this threat, but the fact is that the Local Authority/Government will happily take it. Just not this one. 🙂

Sometimes I can't help, and this week I've had to admit that to someone who I was recommended to. An unmarried couple with 3 children, all under age 18. One child from Mum's previous, relationship ; one child from Dad's previous relationship and one child together. The Dad has died unexpectedly with no Will.

Who decides where the jointly-owned child lives ? Who manages any inheritance which is mainly from his work death-in-service payment ? The surviving partner and the deceased's family are already disagreeing. The biological parent of one of the children has appeared and wants custody.

There is no Will, so no instruction and now almost certainly Court involvement regarding guardianship, parental responsibility and the children's future welfare.

This is an absolute mess and while the family members are busy arguing, the kids are in-the-middle facing uncertainty at the worst possible time. And there's absolutely nothing I can do to help.

A busy start to the working week. Two local client appointments today for Wills and whatever else may need to be included. Also two big client introductions from an excellent IFA near London which need a careful study before bespoke explanatory reports can be sent.

It's been a while since I shared this important information link for home-owners.
