There are two types:

• Property and Financial Affairs — for things such as banking, bills and selling a home
• Health and Welfare — for care, medical treatment and where you live

Putting an LPA in place can help make sure your wishes are known and the people you trust can support you when it matters most.

The Court of Protection is a specialist court in England and Wales. It helps protect people who cannot make certain decisions for themselves because they lack mental capacity at that time.

It can make decisions about health and welfare, property and finances, appoint deputies, and deal with matters involving Powers of Attorney.

Its central aim is to ensure decisions are made in the person’s best interests while respecting their rights, wishes and independence wherever possible.

The Court of Protection makes decisions for people who are unable to make a specific decision for themselves at the time it needs to be made.

Its responsibilities include:

⚖️ Deciding whether someone has mental capacity for a particular decision
⚖️ Appointing deputies to make ongoing financial or welfare decisions
⚖️ Authorising one-off decisions when needed• Dealing with urgent or emergency applications
⚖️ Considering issues involving Lasting or Enduring Powers of Attorney
⚖️ Making decisions about statutory wills, gifts and deprivation of liberty

Yes. You can cancel a registered Lasting Power of Attorney (LPA) at any time, provided you still have the mental capacity to make that decision.

You will need to complete a formal document called a deed of revocation and send it, together with the original LPA, to the Office of the Public Guardian. You should also tell your attorney or attorneys that the LPA has been cancelled.

If you only want to remove one attorney, rather than end the whole LPA, this may also be possible.

It is worth reviewing your LPA if your circumstances or relationships change, or if the person you appointed is no longer the right choice.

A trustee should be someone you trust to manage assets responsibly and make decisions in the best interests of the beneficiaries.

They should be:

🍃 Reliable, organised and financially sensible
🍃 Willing to take on the role
🍃 Able to act fairly and independently
🍃 Comfortable dealing with paperwork and important decisions
🍃 Likely to be available when needed

You may choose a family member or friend, a professional such as a solicitor, or a combination of both. Appointing more than one trustee can provide helpful checks and balances.

The right choice will depend on the type of trust, the assets involved and the needs of the beneficiaries.
