5-Year Roth IRA Rule — Quick Summary The Roth IRA 5-year rule determines when earnings can be withdrawn tax-free. Rule #1: Tax-Free Earnings You must satisfy both conditions: Your first Roth IRA contribution was made at least 5 tax years ago, and You are: Age 59½ or older, OR Disabled, OR Using up to $10,000 for a first-time home purchase, OR Deceased (beneficiary withdrawal) If both are met, withdrawals of earnings are 100% tax-free and penalty-free. When Does the 5-Year Clock Start? The clock begins on January 1 of the tax year for which your first Roth IRA contribution is made. Example: First Roth contribution made on April 15, 2026, for tax year 2025. 5-year clock starts January 1, 2025. Rule satisfied on January 1, 2030. Roth Conversion Rule Each Roth conversion has its own separate 5-year period. Designed to prevent people from avoiding the 10% early withdrawal penalty. Applies primarily to individuals under age 59½. Converted amounts withdrawn before 5 years may be subject to the 10% penalty. Withdrawal Ordering Rules The IRS treats Roth IRA withdrawals in this order: Contributions (always tax-free and penalty-free) Conversions (oldest conversions first) Earnings This means most Roth IRA owners can access their original contributions at any time without tax or penalty. Financial Planning Takeaway For most retirees: Contributions can be accessed anytime. The key planning issue is ensuring the first Roth IRA has been open for at least 5 years before taking earnings. Starting a Roth IRA early—even with a small contribution—can begin the 5-year clock and create future tax-free flexibility. There's a critical distinction we make with every family we work with, and it changes everything about how they approach their planning:

Estate planning is a legal and tax exercise. It answers: How do we transfer assets efficiently when we're gone?

Legacy planning is a values exercise. It answers: What do we want our wealth to do, and to mean, for the next three generations?

Most advisors are very good at the first question. Almost none of them ask the second.
