FMCSA has finalized major updates to the DataQ challenge process — and states will now be held to stronger review and response standards tied directly to MCSAP grant funding.

Here’s what’s changing:

• States must designate crash and inspection DataQ contacts
• Reviews required within 3 years of an inspection and 5 years of a crash
• All decisions must include detailed explanations and evidence reviewed
• States must follow FMCSA policies, including adjudicated citation rules

**New 3‑Stage Review Process:**
• Initial Review (not by the issuing officer)
• Reconsideration (independent SME)
• Final Review (senior decision‑maker or independent panel)

**Timelines:**
• 21 days for initial review
• 21 days for reconsideration
• 45 days for final review

States must submit implementation plans addressing backlogs and future compliance, and FMCSA will begin training this spring with rollout later this year.

These updates aim to increase transparency and ensure more consistent, fair DataQ outcomes for motor carriers.
