Have you reviewed your beneficiary designations recently? As life changes and relationships evolve, keeping your primary and contingent beneficiaries updated is essential to ensure your wishes are honored.
Why Beneficiary Designations Matter
• They bypass your will: Assets with designated beneficiaries—such as life insurance, retirement plans, and transfer-on-death (TOD) accounts—pass outside of probate.
• They take legal priority: Whoever is named on the account will inherit the proceeds, regardless of what your will states.
Choosing How Your Legacy is Passed Down
After choosing your beneficiaries, you must decide how your assets will be distributed if a beneficiary passes away before you. You can structure this in one of two ways:
• Per Capita ("By the Head"): The inheritance is split evenly only among your living beneficiaries. If one beneficiary dies before you, their share is redistributed to the survivors, not their children.
• Per Stirpes ("By the Branch"): If a beneficiary passes away before you, their share automatically drops down to their children, ensuring that specific branch of your family remains protected.
