🏠 From Tax Declaration to Land Title: A Simple Guide for Philippine Property Owners
Many properties in the Philippines start with a Tax Declaration (Tax Dec) but do not yet have a Transfer Certificate of Title (TCT) or Original Certificate of Title (OCT). Here is a practical, step-by-step guide on how Tax Dec property can move toward titled status.
Step 1: Confirm Your Tax Declaration Status
A Tax Declaration is issued by the Municipal or City Assessor’s Office.
It proves that the property is declared for tax purposes, PERO hindi pa ito titulo.
What to check:
Whose name is on the Tax Dec
Property location and boundaries
Year of declaration and revisions
Consistent payment of Real Property Tax (Amilyar)
👉 Important: A Tax Dec alone does not prove ownership in court.
Step 2: Verify Land Classification
Confirm that the land is Alienable and Disposable (A&D) and not forest land, timberland, or protected area. This is done through: DENR CENRO or PENRO

Step 3: Conduct a Survey by a Licensed Geodetic Engineer
A DENR-accredited Geodetic Engineer will:
Survey the land, Prepare a Survey Plan, Submit it for DENR approval
This defines exact boundaries and prevents overlap with neighboring lots.
Step 4: Determine the Legal Basis for Titling
Common legal pathways include:
Judicial Titling under the Property Registration Decree
Administrative Titling for eligible public agricultural lands
Proof of open, continuous, exclusive, and notorious possession since June 12, 1945 or earlier, or as allowed by law
Usually requires: Old Tax Declarations, Affidavits of long possession, Barangay and neighbor certifications

Step 5: File Application and Complete Registration
Once approved:
Court or agency issues an order or decision
Documents are submitted to the Registry of Deeds
A TCT or OCT is issued
Congratulations. The property is now titled and registrable.
