The High Court confirms that finance houses merely finance the "on-road-charges" charged by car dealerships and therefore there has not been any contravention of the national credit act by these credit providers. This supercedes a previous order made by the National Consumer Tribunal in which it directed the credit providers to refund the charges.

The High Court in Pretoria has ruled that VW, Mercedes-Benz and BMW did nothing wrong by financing on-the-road fees.

The new Rule 41A of the High Court requires that every new action or application must be accompanied by a notice, which must be delivered by a plaintiff or applicant with the summons or notice of motion and by a defendant or respondent with a plea or answering affidavit, indicating whether the party agrees to or opposes referral of the dispute to mediation. These notices must state the reasons for each party’s belief that the dispute is or is not capable of being mediated. This notice is delivered on a without prejudice basis and therefore does not form part of the record of the trial or hearing.
