Our intention is to provide easy access to the Funds’ information, as well as to provide other information relevant to retirement funds. The Funds were created for qualifying employees employed in the Electrical Contracting Industry.

A recent ruling by the Pension Funds Adjudicator is a reminder that when it comes to retirement fund benefits, a member’s written will or nomination form is not the final word.

Many people believe their retirement savings will be paid out exactly according to their will or beneficiary nomination. In reality, South African law works differently. Section 37C of the Pension Funds Act requires trustees to prioritise financial dependency over personal wishes when distributing death benefits.

This means trustees must investigate who depended on the member financially and allocate benefits fairly, even if this overrides a will or nomination form. Retirement fund benefits also don’t form part of a deceased estate and are governed by different rules to life insurance and other financial products.

The key takeaway? Estate and retirement planning need regular review and alignment. Keeping beneficiary information up to date and understanding how each product pays out can reduce disputes and help protect the people who truly depend on you.
