At SATIB Insurance Brokers, we believe that sustainable tourism relies on a strong, compliant foundation, which is why we are honoured to be giving a presentation on The Importance of Insurance Compliance in Tourism, presented by Nadia Coward, SATIB Direct Manager. It is incredibly important to us to play our part in vital initiatives that uplift the industry.

Today’s travellers, locally and abroad, are looking for more than standard hotel stays and generic sightseeing. There is a growing demand to experience the true essence of South Africa, the vibrant energy of a township tour, the authentic flavours of a local shisa nyama, and the rich traditions found in rural villages. The heartbeat of the travel sector lies in these grassroots experiences, run by guest houses, community guides, and local transport providers.

To help these smaller players find their footing and thrive in a competitive market, the South Africa Tourism Services Association ( SATSA ) joined forces with Sigma International to launch the SATSA Tourism Business Incubator in May 2022. Led by Craig Drysdale, Director of Inspirations Travel & Tours DMC (voluntary consultant and SMME advocate to Sigma International and SATSA) , this initiative was built with a clear purpose, to make the tourism sector more inclusive, diverse, and sustainable by backing majority Black-owned small businesses.

The incubator selects promising local enterprises, across all 9 provinces and takes them through a fully funded, intensive support programme lasting anywhere from 6 to 12 months.

Rather than offering a generic, one-size-fits-all training course, the programme looks at the exact pressure points of each business. From there, experts step in to provide practical mentorship. This includes setting up proper linkages, access to markets, financial systems, upgrading digital marketing, and building corporate profiles. Crucially, the programme connects these smaller suppliers directly with major industry players, opening doors to contracts they might otherwise never have reached.

As a tourism operator, the safety of your guests is your primary concern. However, when accidents involving vehicles occur, the legal reality in South Africa can be a little more complex. As such, it is paramount that you use a broker who understands these risks, knows how to manage them, and more importantly, understands why specific insurance covers are essential.

The Road Accident Fund (RAF) is designed to compensate anyone injured in a motor vehicle accident, and by law, the RAF is the "first port of call" for bodily injury claims. As such, if a guest is injured in a vehicle-related incident within South Africa, the claim must be referred to the RAF first. This is a legal requirement under South African statute, not an attempt by your insurer to avoid responsibility.

While the RAF covers many "standard" driving accidents, it doesn't cover everything. RAF payout out depends on the specific facts of the incident and whether the injury was directly caused by the "driving" of the vehicle.
Because some scenarios are legally complex, Passenger Liability insurance is essential to step in where the RAF might not. For example:
- If an elephant charges a stationary safari vehicle, the link to "driving" is weak. The RAF may not respond, meaning your Passenger Liability (PL) or General Public Liability (GPL) would need to be considered.
- If an object is thrown at a moving vehicle, it may be argued the injury wasn't caused by the driving itself.
- Injuries occurring while guests are climbing in or out of a vehicle are highly fact-dependent and may not always be covered by the RAF.

The RAF only operates within South Africa. When your vehicle crosses the border into a neighbouring country, you lose that statutory protection.

In foreign jurisdictions, you are exposed to local laws and common-law heighted claims. For any cross-border itineraries, Passenger Liability insurance is non-negotiable. It is your primary shield against injury claims outside our borders.

Your business must be protected from every angle, and we use a combination of two covers that work together, not against each other, to close the "gap" that exists the moment a guest steps onto your vehicle.

General Public Liability (GPL), covers your general business operations (lodgings, walking tours, food, etc.), but excludes incidents involving power-driven vehicles.
Passenger Liability (PL), specifically covers your guests while they are in your vehicles.

Consider the following factors when determining your specific cover limits:
- If you host international travellers, legal costs and claim expectations may be higher.
- The possibility of setting limits "per vehicle" rather than "per seat" to ensure adequate protection regardless of how many guests are involved in a single incident.
- Legal fees mount quickly in injury cases. Ensure your limits account for the cost of a robust legal defence.

Risk management isn’t just about ticking boxes or filing paperwork; it’s about the survival of your business and the safety of the people who trust you with their lives. For lodge owners, tour operators, and activity providers, the "safety net" is built on three things:
- Solid indemnity agreements
- Thorough documentation
- Understanding insurance requirements

An indemnity form is a legal acknowledgement that your guests understand the risks they are taking, whether that’s a bush walk, a water-based activity, or a game drive. To be effective in court, a "good" indemnity needs to:
- Clearly explain the risks involved.
- State that the guest is participating at their own risk.
- Be signed before the activity begins.

While an indemnity won't protect you from a claim of gross negligence, it is your first and strongest line of defence. It proves you did your job by disclosing the risks and that the guest accepted them.

Asking for health disclosures and understanding a guest's physical limits is essential for managing any emergency effectively (pre-existing conditions, allergies, etc.) and serves two vital purposes:
- If something goes wrong in a remote location, your team needs to know if a guest is asthmatic or has a heart condition to make life-saving decisions.
- It creates a record that the guest had the opportunity to disclose their fitness for the activity.

You should strongly encourage, if not insist, that guests have valid travel insurance. But simply asking if they have it isn't enough. Keep a copy of their policy on file so you can see:
- If they can be flown out if they are injured.
- Who you need to call if there is an incident.
- If the policy is active for the duration of their stay.

This documentation means you can get immediate authorization for treatment or evacuation, avoiding any delays or disputes over who is footing the bill.

Many operators use outside contractors for specialized activities like hot air ballooning or diving. If you book these for your guests, you could be held liable if that contractor isn't properly covered. It is important you:
- Request and file their current Public Liability and Professional Indemnity certificates.
- Ensure their cover is high enough for the risk involved.
- Have a clear agreement on who is responsible for supervision and safety during the activity.

The culmination of indemnities, health forms, insurance checks, and Terms and Conditions can protect you from a potentially business-ending liability claim. When you have a complete paper trail, you are demonstrating that you are a professional operator who takes the safety of your guests and the integrity of your business seriously.
