Debt Removal Explanation
I am writing this so that at least some of you take time to do your homework and not fall victim to being scammed.
No one can “clear your name” if you still owe creditors money. So the first step you need to take is to find out who you owe money and how much. You can find many free credit checks online or i can do it for you for free. That will tell you who you owe, which debt prescribed (old debt) and if you have any judgements against your name.
If you know you are “flagged” under Debt Review, but also have a judgement, because you did not continue to pay your Debt Review or it was not included, you need to attend to that Judgement first.
There are only two ways out of Debt Review:
The first one is: pay all your debt, supply your Debt Counsellor with the proof and ask him/her to issue a form 19. The Debt Councillor then has to make sure that your credit record is updated accordingly. You can go to any Debt Councillor to do this if you left your Debt Review and settled all your debt directly with creditors.
The only other way out of Debt Review: You need to approach an attorney to assist you, because you (with the help of the Attorney), need to prove to the court that you are no longer over-indebted. Remember, you went under Debt Review because you could not afford to pay your debt in full. New interest rates and new affordable instalments were arranged and court ordered. You want the court order removed. So something must have changed. Maybe you got a new job which pays more….something that will persuade the Magistrate that you are no longer struggling to pay your debt. This process takes about 2months and is cost (R6000 upwards nothing less).
If anyone offers you a loan whilst you are under Debt Review: they are in contradiction with the Credit Act as it is unlawful, which means that should they grant you that loan it will be investigated and chances are good that it could be written off. But now the same applies to you. If you take a loan whilst under Debt Review without informing the institution that you are under Debt Review it can be investigated and you could be faced with a Fraud charge or reckless lending. The Credit Act is there to protect the consumer, but also to safeguard the creditor.
So now: If a company / person asks you for upfront fees: The NCR prohibits any upfront payment and it is an offence to do so. There is fees in any financial transaction, but worked into the agreement, not charged upfront. Think logically. Today you can buy a car or a home without laying out a cent….all the fees form part of your loan. Why would you then have to pay for a small loan?
Regarding 17.7 transfers and form 19(clearance certificate):
NCR Debt Help System our link to the creditors and to other Debt Councillors has been off line for weeks on end….this delays the process and does not mean that your Debt Councillor is not legit. The NCR and Credit providers have to do all the work manually. You can imagine how many South Africans need assistance, so for now I cannot offer a turnaround time to this.
Guys, google is your best friend. Google a company. Ask if they are registered. Ask for their registration number…. If the person gets annoyed with you for asking too many questions, rather stay away.
My advice is free. I do not mind listening to your situation and guiding you. If we stop creating opportunity for scammers they will become less.
