Here is the part that calms most people down: a Section 129 notice is NOT a summons. It is the letter a creditor must legally send before they can take you to court, and it gives you 10 business days to act.

Inside that window you can pay the arrears, negotiate, or apply for debt review (which protects you and covers all your debts, not just the one account). The notice does not expire in your favour, so the 10 days is a deadline to act, not a wait-it-out period.

A lease is not a credit agreement. The new-credit restriction under debt review applies to loans, cards, vehicle finance and store accounts, not to renting a home. Renting falls under the Rental Housing Act, a completely separate law. Your landlord is not lending you money, so debt review does not block the lease.

Here's the maths nobody warns you about. Take R30,000 out today. After SARS takes its marginal-rate slice, you walk away with about R20,700.

That same R30,000, left invested, would have grown to roughly R125,000 over the next 15 years.

So you're trading R125,000 of retirement money for R20,700 in your hand today. Six rand of future for every one rand of present. No bank in the country charges interest that ugly.

There's a law (the in duplum rule) that says your interest and collection costs can't grow the debt past double what you owed when you defaulted. Good news. But legal fees aren't covered by that cap, so the summons and attorney costs pile on top of the doubled amount.

And the "just disappear for three years and it prescribes" plan? The three-year clock resets to zero the second you make any payment, admit the debt, or get served a summons. That's why the calls never stop, and why a summons lands right before the deadline.

That's how our new article starts, written by a former debt-collection agent. And his message is blunt: going silent on a debt is the worst thing you can do, because he watched it cost people far more than the debt they ran from.

Every letter, call and SMS gets charged to your balance. The collector usually takes about 10% commission on every payment, so R1,000 paid only knocks R900 off what you owe. The longer you hide, the bigger the number grows.
