"We run a tight ship, this won't happen to us.”

It’s a common sentiment among business owners, but the reality of liability is far more complex. Even with perfect intentions and gold-standard safety protocols, claims happen. Why?

1. In terms of the Consumer Protection Act (’CPA’), section 61 provides for Strict Liability, which essentially means that a business can be held liable for a defective product or safety risk even if the business was not negligent. Strict Liability removes the need for the element of negligent to be established.

2. Businesses cannot control the behaviour of Third Party’s such as contractors, vendors or members of the public who are on their premises. Businesses can only control their staff, but even then, only to a certain extent.

3. Latent Risks, like professional errors or minor oversights in a contract can arise long after works have been completed.

“Reasonable effort” is easy to claim - until it is tested after the fact. Because when something goes wrong, the standard is not your intention but rather it is what a reasonable person should have and would have done instead.

That’s why liability isn’t about reacting - it is about doing what is right from the start.
