*Judge Says No to Car Repossession*

The Western Cape High Court recently considered a case in which a Credit Provider sought a judgment to repossess a motor vehicle after the borrower defaulted on payments under a credit agreement coverer by the National Credit Act (NCA).

Before approaching the Court, the Credit Provider issued the required Section 129 notice, offering the borrower an opportunity to settle the arrears. The borrower responded, expressing willingness to make payment arrangements, but the Credit Provider insisted on no less than 50% of the arrears upfront and the balance within three months.

The borrower, citing financial distress, could not meet these terms and with the Credit provider being adamant in its demands, no agreement was reached and the Credit Provider proceeded with the repossession application.

The Court criticised the Credit Provider for failing to engage meaningfully with the borrower, noting that this approach conflicted with the spirit of the NCA and South African jurisprudence. It found the provider’s rigid demands reflected a power imbalance and highlighted the borrower’s genuine effort to settle the debt. As a result, the Court declined to grant the judgment for repossession holding that the borrower had not been given a fair chance to regularise the account.
