🚓 Would I get sent to jail for not paying my debt?
No. You cannot be sent to jail for failing to pay your debt. But this does not mean avoiding your debt will come without consequences. Assets could be liquidated, you could be sequestrated, or you could receive a garnishee order, where your employer will withhold a portion of your income and pay your creditors directly.
⚰️ What if a family member passes away, am I responsible for their debt?
It depends. When a loved one passes, both their assets and liabilities are placed in a single estate. From here their financial situation will be assessed.
If their liabilities are larger than their assets, then the liabilities will be cancelled. Their debt will be made null. It will not be turned into a burden you have to carry.
However, if you have signed a joint contract with a loved one or you’re married in COP, you will be held responsible for the debt.
But this will only apply to debt gathered during the marriage or in regard to the specific contract signed.
🚗 Will I lose my car or other assets because of debt?
Unfortunately yes. Your creditors are allowed to repossess your assets, like your home and car if you fail to keep paying your debt.
The scariest thing is a Section 129 Notice or a Letter of Demand. This is a notice you receive in the mail (sometimes email) that legal action is being taken against you by your creditors. You will have a period of 10 days to get hold of your Debt Counsellor after receiving the notice. You may have your possessions taken away from you to help settle your outstanding debt.
HOWEVER...
You have the power to avoid it all!
If you sign up for debt review, your Debt Counsellor will negotiate a brand new repayment plan with your creditors, and they will no longer be able to repossess your assets.
