Fiduciary Dispute Resolution is the process of resolving disputes between parties, such as heirs, executors, and claimants.

The term dispute resolution is sometimes used interchangeably with conflict resolution, although conflicts are generally more deep-rooted and lengthier than disputes.

Bespoke Executor Services (BEXs) assists clients and Financial Planners with dispute resolution in the Fiduciary context. During this process, we assist the client or financial panner with any fiduciary dispute they may be having with a Fiduciary Practitioner as it relates to Deceased Estate or Trust Administration.

Conducting a due diligence of the Trust ensures that there is compliance with the accounting rules and regulations. A Trust Report is required to be prepared each fiscal year by your Accountant to report the findings of the Trust Audit. The relevant Professional Standards Regulation Board will provide a list of procedures to be followed to complete the annual Trust Audit.

Should the original Will be misplaced or lost, the costs of having a certified copy of a Will accepted as the original is in the hands of the High Court and is an expensive exercise. Ensuring that your original last Will and testament is safely stored and readily available for interested parties when it is needed, is the sensible thing to do.

Too many cooks really do spoil the broth. We recommend having no more than 2 copies of your Will. The original and a copy, why? The Master’s office only accepts your original signed Will. Keep in mind, if you have many copies of your Will the person wrapping up your estate needs to process an application with the High Court to prove that the duplicated Will is, in fact, yours. This could cause delays in finalising your estate.
