SARS had a two year rule by which a person, will be penalised for non submission of income tax returns. This meant that if a person was compiled to file an income tax return and had two or more outstanding returns, that SARS will start levying a monthly non submission penalty on all returns that are outstanding for two years and more.

This however has now changed and from this year, penalties will also be levied on 2021 income tax returns also, that are outstanding as from 1st December 2021.

Just take note that it applies to non provisional tax payers. Provisional tax payers will also be levied a penalty but from 1st February 2022.

For employers, this will also apply to all other tax types that are filed late.
