Many times I get asked during the winter season, what happens if I hit ice and and accident occurs because of it? Is it my fault? Am I considered at fault by my insurance company? What if I go into the ditch and do not hit anybody? Am I still at fault?
In Ontario, we have what is called the ‘No Fault’ system. It is a confusing name, but what it means is, it does not matter who is at fault in an accident, your insurance company pays for your claim. Also, when collisions occur, there always is a driver considered at fault.
If you hit ice and end up in the ditch or hit a vehicle in front of you, the at fault status of the accident will get assigned to your claim. If you have claim forgiveness, this waiver will apply to the claim and protect your rates. Should you not have it, your driving record will drop to a zero, and you may have to be remarketed to a company that will accept the at fault accident on your renewal. Many times you can expect to pay double or triple the rate if this happens at renewal time.
In order to try to avoid this entirely, I would recommend winter rated snow tires as they are much more malleable, and are much more effective in cold conditions, including ice.
Also, there is no substitute for driving at a speed that you may be able to make an emergency stop and leave at least a car length of distance between yourself and other vehicles.
At your renewal time, your broker should be contacting you to ask if you have winter tires, and apply the appropriate discount to your insurance. Also they should ask if you are interested to add accident forgiveness if you previously did not qualify.
Sometimes accidents are unavoidable, but if you follow these tips, you will keep a healthy driving record and it may save you thousands of dollars.
