According to NHSTA, an estimated 38,680 people died in motor vehicle traffic crashes last year, representing an increase of about 7.2 percent as compared to the 36,096 fatalities reported in 2019. What is surprising is that this increase was during a year where total miles driven decreased.

This is why I want to share information on UM/UIM (uninsured motorist and underinsured motorist).

What's UM/UIM?

This is coverage that is available under your Auto and Umbrella coverage to protect assets and pay for medical and legal expenses if the other driver is at fault. UM/UIM protects the insured if the person who caused the accident doesn't have insurance or has too little coverage for the damage.

Since most discussions on an auto policy revolve around liability coverage, comp and collision, and/or deductible, some insureds do not even know this coverage is available or have it set very low because they do not understand it.

If you add UM/UIM to your umbrella policy, it will provide coverage on top of the underlying auto policy,.

California Insurance Commissioner's Order resulting in workers’ compensation premium savings for California businesses affected by COVID-19.

Per the press release on 6/17/2020:

"Under these emergency regulations, employers are permitted to reclassify an employee if the employee’s duties have changed to a clerical classification that has reduced risk than the employee’s previous classification. This reclassification will reduce the employer’s premiums for employees who are a lower risk because they are now working from home even though they may not have previously done so. This change would be retroactive to March 19, 2020, the first day of the Governor’s statewide stay-at-home order, and conclude 60 days after the order is lifted."

"This new regulation will also exclude claims related to a COVID-19 diagnosis from being included in future rate calculations so that employers are not penalized with higher rates due to COVID-19 claims."

"Insurers will also be required to report injuries involving a diagnosis of COVID-19 which will allow the Commissioner’s statistical agent—the WCIRB—to keep track of COVID-19 injuries, and will aid in the WCIRB’s future analyses of the workplace and market impacts."

"The new regulations will go into effect on July 1, 2020."

This could be great news for some businesses depending if they were able to send the higher risk employees home to do clerical work and to have claims related to COVID-19 not count against your experience.

Most likely, you would be able to do this reclassification when you do the worker's comp audit at the end of the policy term. Any questions, please speak with the carrier or your insurance agent.

I know restaurants right now are having a tough time with some closed fully, and others doing only take-out and/or delivery. For those who are doing take-out and/or deliver, I first want to thank you for staying open for those of us who need food and doing what you can to keep your employees employed. Please stay safe as best as you can.

Second, I want to make sure you are covered for what you are doing. Take out is not an issue, every restaurant does that as part of their normal workday. Those who have always offered deliveries should also be fine as long as you and your agent have put in place the correct coverage. If you have recently started deliveries due to the COVID-19 virus, you may not have proper coverage as the business owner or your employees who might be doing the driving.

When you add delivery to your restaurant, you are taking on additional risks. Your insurance policies usually do not cover these risks unless you have notified your agent and the insurance company. In fact, some insurance companies that provide coverage to restaurants would not offer coverage if the business included deliveries. This can include your commercial liability and your worker's compensation policies.

In addition, you are most likely to have employees use their personal autos to make deliveries. At a minimum, you will need a commercial auto policy to cover Hired and Non-Owned autos. Also, if you are using your own personal car for deliveries, you need to make sure your personal auto policy is aware and find out if they will cover you if there is an accident while delivering for your business.

We are already going through some difficult times and it does not need to be compounded by a non-covered claim due to not having the proper coverage. Please contact your current agent to talk to them about these concerns and to make sure you are covered going forward.

UPDATE 1:

Some worker's compensation carriers have notified us that although normally they would not cover workers injured for delivery, they are removing that exclusion temporarily due to restaurants having no choice, but to offer delivery. PLEASE NOTE, this might not be all worker's compensation carriers so you will need to contact your agent or your carrier to see if this applies to you. Also, some personal auto carriers are also temporarily modifying their policies to cover using personal vehicles for delivery. Again, check with your unique carrier to make sure this applies to them. This information is not absolute and it does not apply to every carrier, it is your responsibility to check with your agent or carrier!

Over the next several weeks, coronavirus will be changing the way we all live and work. There are a number of issues as employers that you will need to deal with. Additionally, the EDD has established a program for CVOID-19 that allows employers to apply for the Unemployment Insurance (UI) Work Sharing Program if reduced production, services, or other conditions cause them to seek an alternative to layoffs.
