The most recent COVID relief package, the Consolidated Appropriations Act (CAA) of 2021, offers optional relief for Health Care Flexible Spending Accounts (FSAs) and Dependent Care FSAs for plan years ending in 2020 and 2021. As the new rules are optional, employers need to opt-in to these changes for them to take effect and plan amendments must be made. The changes impact carryovers, grace periods, mid-year election changes, the Dependent Care Account age limit and FSA spend down for terminated coverage.
