An HOA board denied a homeowner's architectural request. The homeowner sued β€” and named each board member individually.

Volunteer status doesn't stop this. Good intentions don't fund a legal defense.

D&O insurance covers governance-related claims against board members personally. Most HOA boards carry it. The question is whether the limits are adequate and whether the exclusions match the community's actual exposure.

For employers with January 1 effective dates, August is open enrollment prep season.

SHRM's 2026 research makes the challenge clear: organizations are not struggling to offer more benefits. They are struggling to get employees to understand and use the ones they already have.

The difference between an effective open enrollment and a forgettable one is almost entirely a communication and education question. That work starts now, not in September.

Nearly 100 million Americans are underinsured for life insurance, according to LIMRA's 2026 Insurance Barometer Study.

The most common reason is that people assume their employer's group life coverage is enough. In most cases, the median benefit is $20,000 flat or one times salary. That amount covers a portion of what most families actually need.

September is Life Insurance Awareness Month. August is the right time to review where you stand. Tooher-Ferraris offers life insurance tools and quotes at https://zurl.co/9iL1K

Buyers are asking about insurance before they make an offer now.

"What will coverage cost?" "Does this roof qualify?" "Are we in a flood zone?" These questions used to come up after the contract was signed. In 2026, they're coming at the showing.

Real estate professionals who connect buyers with an insurance contact early create smoother transactions. Those who try to answer the questions themselves create E&O exposure.

If you do design-build work, your builder's risk program is worth a specific review.

Standard builder's risk forms cover traditional construction well. Design-build delivery creates considerations those forms may not address: the pre-construction design phase, how professional liability exclusions interact with design-build scope, and how delays caused by design decisions are treated under delay in completion coverage.

Design-build now accounts for more than 44 percent of US construction volume. The project insurance programs protecting that work deserve to match the delivery method.

Private company directors and officers face claims from employees, creditors, regulators, and minority shareholders.

None of those claimants need a stock ticker. All of them can pursue the individuals who made the decisions β€” personally β€” when D&O coverage isn't there.

D&O insurance for private companies is competitively priced in 2026. The time to put it in place is before a claim forces the conversation.
