Pool toys – noodles, floaties, dive rings, kickboards, beach balls etc – are a lot of fun. But they also have dangers of which we must be aware.

When left in and around the pool they attract the attention of children who may try to get through or over a fence or reach out to try and get the toy from the pool’s edge.

My client forwarded me photos of the pool equipment at prospective new account. Notice that the heater is installed under a wooden deck and only three feet from a bedroom window. There is no stack, allowing carbon monoxide to freely waft into the house through the nearby bedroom window. Here is the same equipment viewed from the outside. My client is having a problem with the residents of a commercial pool account, who complain about everything he does including padlocking the gate when he drains the pool. They insist on having keys to the equipment room and he's concerned about someone getting hurt around the equipment. The property manager seems intimidated by the residents and is asking him for written proof that these safety precautions are legally required. [ 142 more words. ]

I recently received a telephone call from a pool technician who told me that he had been terminated from a residential pool account. He explained that he had the customer for over 5 years . Now the customer is very angry and refuses to pay for the last month of service. He called me for some detailed advice on how best to win his case in small claims court for the unpaid fees. Swimming pool heaters are commonly installed in equipment rooms at apartment houses, condominiums and hotels and code requirements provide that these indoor heaters be vented outside the room. An obstructed vent could lead to a hazardous level of carbon monoxide that could put the lives of the building occupants at risk. Pool techs are well aware of the dangers of carbon monoxide and it is foreseeable that the vent could be come blocked by a bird nest, debris or other obstruction. [ 92 more words. ]
