We have heard that The ABLE Age Adjustment Act (S. 331/H.R. 1219), which would raise the age of disability onset to 46, was included in the Omnibus spending bill Congress will pass this week and then send to President Biden for signature. We understand the act will not go into immediate effect, as ABLE programs will need to update their processes. The change will begin in tax year 2025.

The ABLE Age Adjustment Act is a win for advocates who had been trying to use a higher age than 26 for many years. The biggest impact will be felt by individuals with acquired and late onset physical disabilities who will be able to have more control of their assets while using Medicaid supports and SSI. We believe this is a step in the right direction of moving the vision of the ABLE to be an account for Working Adults, and not based on childhood disability.
