Will you be subject to a penalty at tax time?

Recently the IRS has signaled that it is going to move ahead with enforcement of both the individual mandate and the employer shared responsibility mandate. ( Employers with 50+ employees.)

The president signed an Executive Order Minimizing the Economic Burden of the Patient Protection and Affordable Care Act Pending Repeal (January 20, 2017) that directed federal agencies to exercise the authority and discretion permitted to them by law to reduce potential burden imposed by the ACA. However, this Executive Order does not change the law; the legislative provisions of the ACA are still in force...taxpayers are still required to follow the law, including the requirement to have minimum essential coverage for each month.

At a recent meeting in Sacramento, Covered California announced that insurance plans under the Affordable Care Act will rise an average of 12.5 percent. Officials also said Anthem, a major insurance carrier will also stop offering plans in most of the state.

ANTHEM JUST ANNOUNCED IT WILL DISCONTINUE MANY CALIFORNIA INDIVIDUAL PLANS IN 2018

HOW WILL THIS AFFECT YOUR COVERAGE?

Next year, Anthem will offer plans in three regions of Northern California only, which will include Redding, Santa Clara County, and Stockton/Modesto.

It's important to note that these changes do not immediately impact the benefits of Anthem members currently enrolled in their Individual health plans. They can use their health benefits without interruption until the end of the year.

This decision does not affect those who have employer-provided insurance, those with Medicare Advantage, Medicare Supplement, Medi-Cal or those enrolled in "grandfathered" plans (plans purchased before March 2010). Additional information and resources for members affected by changes to their 2018 health care coverage are available at Anthem.com/CaliforniaChanges.

All 11 health insurance companies will return to the Covered California market in 2018, however, ANTHEM WILL BE LEAVING SOME CALIFORNIA COMMUNITIES THAT MAKE UP ABOUT HALF OF ITS ENROLLMENT. WHAT TO DO WITH LEFT OVER FSA DOLLARS....
So some of you have a flexible spending accounts (FSA). You love using this tax-advantage plan to help manage your out-of-pocket medical costs. But, what happens if you have money left in the FSA account by the time year-end rolls around?

Q. Can an employer give those employees back their unused withholdings as taxable income?

A. No. An employer can’t return an individual’s withholdings to them if they have leftover money in their FSA at the end of the plan year.

A health FSA will have leftover money, or experience gains, if salary withholdings along with employer contributions exceed health FSA reimbursement for that plan year. These experience gains are also called forfeitures because they’re the result of participants forfeit unused FSA balances under the use-or-lose rule.
