Why use a trust instead of a will?
A living trust, unlike a will, can keep your assets out of probate proceedings. A trustor names a trustee to manage the assets of the trust indefinitely. Wills name an executor to manage the assets of the probate estate only until probate closes.
Disadvantages of a Trust in a business include the fact that they can be expensive to maintain and problems can be encountered when borrowing due to additional complexities of loan structures.
Other alternatives or uses of a will and trust including a buy sell agreement with a business partner or key employee can work if coordinated with your legal documents in estate planning.
