Chicago, Baltimore, Columbus, and Pima County, Arizona are suing the Trump administration over the finalized ACA plan changes for 2027. The group feels these provisions are unlawful:

1. Multi-year catastrophic plans. Currently, these plans can only span a year, but will be extendable for a decade under the new rule.

2. Higher out-of-pocket maxes. These tend to raise every year, but $24,000, they argue, is simply too high.

3. Non-network plans, allegedly, will not adequately provide coverage.

Wait to see if these changes are put on hold.

Another 160 drugs were added to the Trump administration’s direct-to-consumer drug platform, TrumpRx.

This brings the total of available drugs on the platform to 800, making 4 out of 5 drugs taken in America available at "most favored nation" prices.

Clover Health was able to claw back $120 million of star ratings bonus money in court.

A Georgia judge found CMS's measurements bringing the plan's star rating from 4.5 to 3 were "procedurally invalid" and therefore must be reversed.

Unless CMS wins an appeal, an industry-wide recalculation may be in order, with more bonus money doled out to those who were affected by the 10 measures in the dispute.

In the ultimate "Mom didn't say I COULDN'T do that" court case, generic drug manufacturers just got a huge Supreme court win.

The really, incredibly short version:
In the US, brand-name manufacturers file patents on drugs treating specific conditions. Other indications are filed separately, and each patent lasts 20 years.

When a patent expires, generic manufacturers make their own version. They use a "skinny-label" strategy, marketing theirs to treat ONLY the first condition. However, its often prescribed like the name-brand drug.

The Supreme Court just gave that practice its blessing, so long as the drug isn't affirmatively marketed to treat those other conditions.

For and pros, know this: This makes it safer for generic manufacturers to produce more drugs cheaply.

Whenever a state can't use payroll tax information or other records to prove an enrollee is compliantly engaging with the community, employers will be asked to provide supporting documentation.

Employers will have 30 days to respond.

Failure to comply with the request puts the employee in a bind; they won't be eligible for Medicaid, nor premium tax credits.

CMS, the Employee Benefits Security Administration, and the IRS are teaming up to launch a new Independent Dispute Resolution Gateway. When it becomes operational, carriers and plans will have 90 days to sign up.

The gateway will contain basic information about each plan and plan sponsor, as well as force the use of standardized codes to help IDR entities speed up dispute resolution under the No Surprises Act.

If a provider enters a No Surprises Claim, the insurer will have five days to respond; providers will also have a five-day deadline to respond and provide any additional requested information.

In the long-run, centralizing this data means that insurers, employers, and benefit advisors could get more insight into their No Surprises Act claims, and help to fend off claims ineligible for dispute resolution.

Sometimes, bad behavior begets bad behavior.

After feeling like their dentist was aggressively upselling procedures, many folks stop getting preventive dental care altogether for a short while.

When they do finally select a new dentist, deep cleanings are often recommend -- which cost around $1,000, or 10x more than a standard cleaning, if you're keeping score at home.

And so the patient shies away again.

But when something does go wrong -- cavities, root canals, crowns, etc. -- those expensive procedures eat into employee and employer budgets alike. Those deep cleanings, as it turns out, are becoming increasingly necessary.

Education just might be the cure.

A bill to prevent PBMs from paying brokers referral fees or similar compensation arrangements has unanimously cleared a key House vote.

Several committee members on both sides of the aisle favor the policy, as they believe these payments from PBMs cause brokers to steer employer selections, rather than shop for appropriate-fitting solutions.

A House committee has unanimously (read: BOTH parties like it) advanced a bill requiring hospitals use separate billing identifiers to differentiate services rendered in a hospital-level facility from others.

The bill represents an attempt to curb a side effect of consolidation: hospitals have been purchasing freestanding practices, and charging hospital-level facility fees, even if the practice is far off-site.
