‼️FUTURE BUYERS‼️
We are seeing ome changes in 2026. The biggest change will be the state’s requirement for Agents to have a signed Buyer’s Representation Agreement BEFORE showing homes to a new client.
This is something that has been required of us by the National Association of Realtors since August of 2024, but has now been codified by Texas.
“The biggest Texas real estate law change for January 1, 2026, is Senate Bill 1968 (SB 1968), modernizing the Texas Real Estate License Act to mandate signed buyer representation agreements for substantive talks, outlining compensation, and adding new broker responsibilities, aligning with new national rules and emphasizing transparency.”
“Written agreements required: A license holder who performs any real estate brokerage act (including showing property or making an offer) must enter into a written agreement with the buyer before taking those actions.” (SB 1968)
