In 2021, President Biden reinstated the Comprehensive Environmental Response Compensation and Liability Act when signing the Infrastructure Bill, taking effect in July 2022, and continuing for 10 years. The Infrastructure Bill of 2021 significantly changed the 1980s version of the tax, lowering the threshold from at least 50% of chemicals in IRC section 4662 down to 20%.

That means, your chemical substance could qualify as taxable if the taxable chemicals listed equal more than 20% of the weight or 20% of the value of the materials to produce.
