Most contractors read 'to the fullest extent permitted by law' and move on. That phrase can shift liability to you for things that go well beyond your own negligence. In some states it can shift a portion of the other party's own negligence onto you. Your GL policy has limits on what it covers within insured contracts. your GL policy is built to handle. A duty to defend means paying the other party's
legal costs immediately at claim filing — before fault is determined. Your policy

Before you sign your next construction contract, read the indemnification section. Two things to look for: is the language narrow — limited to your own negligence — or broad, using language like 'to the fullest extent permitted by law'? And does the clause include a duty to defend? If both are present in the same clause, that's the combination worth flagging to your agent before you sign. Not after.

GL renewals are up right now — most contractors I'm talking to were expecting flat
and are getting hit with increases instead.

That's the context for today's video. Because there's a contract clause that can
make it worse.

Indemnify and defend show up together in almost every construction contract. Most
contractors sign both without knowing the difference. Your GL policy does not treat
them the same way. Indemnification is a financial obligation your policy is built
to handle. A duty to defend is an immediate obligation to fund legal costs the moment
a claim is filed — and your policy may not be built to cover it at all.
