Staff of an insured OMS left two voicemails with a patient to discuss tongue lesion biopsy results that included moderate dysplasia. These were the last documented efforts to reach the patient.

Two years later, the patient reported a lump in his throat to his general dentist and was asked why he had not followed up with the OMS as advised. The patient claimed the OMS office had left a message saying results were inconclusive. The patient was eventually diagnosed with squamous cell carcinoma and passed away. His estate filed a wrongful death lawsuit alleging failure to diagnose.
