When looking to purchase real estate it is important to understand the various types of deeds that are used. A deed is the formal document which transfers ownership of real estate. There are three common types of deeds and each have key differences. A general warranty deed provides the highest level of protection for a buyer. The seller (grantor) provides a comprehensive guarantee to the buyer (grantee) that they have clear title to the property and will defend the grantee against any title defects or claims that arise-including those which existed before the seller's ownership. A special warranty deed is more commonly used. This provides a more limited warranty as compared to a general warranty deed. With a special warranty deed the seller guarantees against defects which occurred during their period of ownership but makes no promises as to issues from before they owned the property. A quit claim deed provides the least protection to the buyer. In this type of deed, the seller simply conveys whatever interest they might have to the property without making any guarantees or warranties as to the title.

We are often asked about the Pennsylvania Clean & Green Law. This is a preferential tax assessment program that lowers property taxes on qualifying land. Rather than being taxed at its fair market value, enrolled land is assessed based on its current use as farmland, forest or open space. The program is intended to encourage preservation of these valuable lands by offering a significant tax incentive. However, landowners who remove land from the program or change the use of the property are subject to paying back the tax savings plus interest. To qualify a property must be at least 10 contiguous acres and devoted to either agricultural use, agricultural reserve, or forest use. A landowner who violates their Clean & Green agreement face "rollback taxes." The rollback tax is the difference between the taxes which were paid under the program and what would have been paid based on fair market value. The tax is calculated for the current year and the last 6 years, plus simple interest of 6% each year.

We are often asked what is title insurance and why do I need it-
Simply put title insurance protects the insured from financial loss relating to defects in the title to the real estate. Unlike unpaid property taxes or liens, these defects might exist before the purchase of the property and may not always be obvious through an ordinary title search. Title insurance protects against potential claims related to past ownership issues.
