3 Things You Can’t Do as a Notary:

1. Don’t endorse advertising
Never use your seal or title to back products, contests, or promotions. It can mislead people and isn’t allowed.

2. Don’t give legal advice
Only attorneys can explain legal documents or tell someone what notarization they need. Stick to notarizing.

3. Don’t make documents “legal”
A seal alone doesn’t make a paper valid in court. Only perform proper notarizations under state law.

Learner’s Permit as ID?

If the permit says “Not for ID purposes” you can't use it as an ID.
If state law allows learner’s permits may be accepted as an ID, if it has have both a valid photo and signature. States that accept it: Illinois, Massachusetts, Texas, and Nevada (check with your state law to confirm). In California and Florida Learner's Permit is not accepted.
If there are no clear guidelines it is safest to have the signer bring another form of identification.

Notary work carries real responsibility! Even a small oversight such as skipping an oral oath or affirmation can cross into the realm of criminal wrongdoing. Notaries must follow each required step exactly to avoid serious legal consequences. Always stay sharp and stick to best practices to protect yourself and your commission.
- Understand when a sworn oath or affirmation is necessary and give it verbally.
- Make a note in your Notary journal that you administered it out loud.
= Never cut corners when notarizing, no matter who the request comes from.
= Know what official misconduct is and steer clear of it completely.

Curious about notarizing foreign-language documents? Here are three key questions to guide notaries:

1. Are you able to communicate directly with the signer? It's a must have in most stsates, except Arizona or Mississippi.
2. Have you compared the signer’s signature on the document with the signature on their ID? Make sure the signatures on the document and ID are similar.
3. Can you read and understand the Notary certificate wording? If the certificate is in a language you don’t know, attach the correct English version or decline the notarization. Always note in your journal if the document is in a foreign language and include any English titles or descriptions when possible.

Protecting Signer Privacy: Tips for Notaries

When you notarize documents, you’re handling sensitive personal information. Even a casual comment or social media post can lead to a serious privacy breach. Here are three key things to remember:

- Don’t leave your Notary journal unattended. Always keep it in a secure place when not in use.
- Don’t chat about signer information with friends or colleagues, even in passing.
- Don’t post any signer details on social media or in online discussions.

Privacy matters. Even well-meaning slips can put you and your clients at risk. Stay professional and protect your signers at all times.

Top 3 Requests Notaries Must Always Refuse:

1: Skip the ID part
You must follow state laws and properly identify every signer. If they lack ID, some states allow alternatives like credible witnesses, but never skip ID.

2: Notarize a documents without physical presense of a signer.
The signer must be present. Notarizing without the signer is illegal and could lead to lawsuits or losing your commission.

3: Change the notarization date?
Back-dating or post-dating a notarization is illegal in all states and could result in serious penalties. Always use the actual date.

Stamping Notary certificate wording on a document instead of attaching a separate page with the required wording.

A notarial certificate doesn’t need to be a separate form attached to the document. A notary can use a stamp with the notarial certificate wording and apply it directly to the document. One advantage of using a stamp is that it eliminates the need for a description of the record, which is required for attached certificate forms.

If you choose to use stamps, ensure you have stamps for all types of notarial acts: acknowledgment, verification on oath or affirmation, signature witnessing, and copy certification — that you may perform. Additionally, make sure the stamps use 10-point type (font) to meet the requirements of your state recorder's office. Make sure to check with your state on other applicable requirements.
