the internet is lying to you about land trusts and subject-to deals

some gurus say a land trust is a magic shield. naysayers say transferring title is illegal mortgage fraud.

both are wrong. here is the actual breakdown:

1. due-on-sale (dos) is contract, not crime. a lender's right to call a loan isn't a criminal law. it's just a civil contract rule. it is only fraud if you actively lie, forge docs, or deceive them about it

2. the assignment loop. under federal law (Garn-St. Germain), you can put a property into a trust for privacy without triggering the due-on-sale. but when you transfer that trust's beneficial interest to an LLC, it technically triggers the clause. contract violation? yes. fraud? no

3. how to manage the risk. banks want payments, not properties. they rarely enforce a dos on a performing loan. to manage this practically:
- make payments on time, always
- get insurance right (name both trust and original borrower)
- use a licensed third-party servicer to keep things transparent

creative finance is about solving real seller problems. keep the paperwork clean, protect the seller's credit, and build your portfolio.
