Today, The Supreme court ruled that the VICTIMS in a criminal case have the right to be considered in setting bail. The severity of the crime and flight risk CAN be considered. The Supreme Court acknowledges that Bail is part of the due process in the Criminal Justice System. The court ruled that Bail is necessary for both the Victim and Defendant.
This case started out as another attempt to remove the right to Bail in the State of California, that is guaranteed by the United States Constitution and The California Constitution. The Court ultimately ruled that Bail is the law of the land and will remain for now. The court ruled that the Victims rights to justice and protection shall be one of the factors considered in setting bail. The court ruled that victims matter in this justice system. The Bail Bond system ensures that the Defendant appears in court, while at the same time allowing The People their rights to the principle of "innocent till proven guilty". The United States of America does not exist without protecting the rights of both the Victim and the Accused. If one or the other is not afforded their rights, we do not have a justice system and we will not have a free country.
