Social Security COLA expected to rise for 2027

Why Are Beneficiary Updates Critical?

Beneficiary designations overrule your will.

The Beneficiary Designation Rule states: A Transfer on Death (TOD) or Pay on Death (POD) designation is a contract with a financial institution. It transfers the account directly to the beneficiary upon death.

SCENARIO

Sally, Age 62

Her will states: All assets divided equally between my two sons. Updated 2025.

Her IRA ($500,000) still lists her ex-husband as the primary beneficiary from 2021.

Ex-husband receives $500,000

Sons receive $0 from the IRA

Sally's will does not override the beneficiary designations. Probate will never see it.

This also applies to: IRA beneficiaries, 401K beneficiaries, life insurance beneficiaries, POD bank accounts and joint accounts with right of survivorship. All override the will.
