FBI Warns Emerging Kali365 Platform Is Supercharging Phishing Attacks

May 26, 2026

The FBI warned businesses and consumers about a rapidly emerging cyber threat that could make phishing attacks more sophisticated, scalable and difficult to detect.

In a recent Public Service Announcement, the FBI detailed a Phishing-as-a-Service (PhaaS) platform called Kali365, which allows cybercriminals to bypass multifactor authentication (MFA) protections and gain persistent access to Microsoft 365 accounts. First identified in April 2026, the platform is being distributed primarily through Telegram and is lowering the barrier to entry for less skilled attackers.

For the title and settlement industry, the warning underscores the continued evolution of business email compromise (BEC) and wire fraud schemes targeting real estate transactions.

A small typo today can lead to a major title claim tomorrow.

Today's tip:

It’s common practice to pull the legal description from a prior deed, but relying on old data without verification is a high-risk habit. If the prior deed contained an error (like a transposed lot number or a missing call in a metes-and-bounds description) your new policy may be insuring the wrong "dirt." The legal description is the heart of your title policy. Taking a moment to verify it against the plat ensures that the interest you are insuring is exactly what your client thinks they are buying.

Help us, help you find your prior policy.

Most title companies have access to multiple databases beyond their own and unfortunately, there's no universal standard for how policies are indexed. Some databases return the best results by property address, others by Plat Book and Page, and some policies don't appear to be uploaded to any system at all.

How can you get better results on your prior policy lookups? A few simple steps go a long way:

- Attach a current deed. This single document contains most of the information needed to locate a policy quickly.

- Include the County. This one is critical and easy to overlook.

- Include the property address and legal description.

- Include the current owner and if you have a moment, a prior owner or two as well.

Title Tip:

Always confirm marital status - every single time. Even if only one name is on the deed, a spouse may still have legal interest in the property. If a married seller signs alone, you risk leaving a cloud on title that can surface later. The same goes for a new Deed of Trust. A quick check and ensuring the proper parties sign at closing can prevent a major issue down the road.

Breaking News: Texas court orders FinCEN rule to be vacated

The U.S. District Court for the Eastern District of Texas agreed with a Texas title agency in Flowers Title Company v. Bessent that the Financial Crimes Enforcement Network’s (FinCEN) new residential reporting rule is unlawful and ordered the rule be vacated.

The court said the final rule exceeds FinCEN’s statutory authority under the Bank Secrecy Act.
