New construction does not eliminate title risk.

While the structure is newly built, the land itself has a history — and that history can include:
• Prior ownership disputes
• Easements that limit how part of the property can be used
• Boundary conflicts with neighboring properties
• Contractor or mechanic’s liens filed after closing
• Recording errors during development

Title insurance protects against issues tied to the land’s legal history — not just the building itself.

New does not automatically mean risk-free.

Beginning March 1, 2026, settlement agents will be required to report certain residential real estate transaction information to FinCEN when the Buyer is an entity (corporation, LLC, etc.) or trust and there is no lender involved with an anti-money laundering (AML) program.

To comply with the reporting requirements, settlement agents will be asking Sellers and Buyers for information concerning:

• Reporting person information
• Closing date
• Property address and full legal description
• Transferee/Buyer information
• Person(s) associated with the transferee (authorized signers and beneficial owners)
• Transferor/Seller information
• If the Transferor is Trust, the trustee’s information
• Purchase price
• Payment information, including bank account details for sourcing funds
• Detailed payment information for payments made on behalf of the Transferee/Buyer

These categories are required by FinCEN — settlement agents do not have a choice. As an industry, it’s important that we work together to educate our clients so they are prepared to provide and certify this information before closing.
