🍗 GET READY...THANKSGIVING IS 1 MONTH AWAY! 🍗

Thanksgiving is one of the biggest holidays in the U.S. It usually falls on the last Thursday of November every year. On this day, most Americans don’t go to school or work, but rather they stay home and spend time with their families, as well as eat lots of Thanksgiving food. Many people use this holiday as the mark of Fall ending and Winter starting. This tradition officially started in 1789 by Former President George Washington. The name “Thanksgiving” was given with the hope that Americans can express gratitude for the U.S. independence, and the successful ratification of the U.S. Constitution.

The majority of American families start their Thanksgiving meal at around 1-3pm. They will eat Thanksgiving food like turkey, smashed potatoes, pumpkin pie/apple pie, apple cider, etc. They will spend hours eating and talking at the dinner table. After that, people tend to split up, some will take naps, others watch the football games on TV. Some families even divide up into two teams to play football themselves. At around 5-7pm they will start eating again.

🎉 Macy’s Annual Thanksgiving Parade 🎉

This is one of America’s Thanksgiving traditions. In the morning of Thanksgiving day, everyone will surround the TV, or if they’re in New York, they will go to Manhattan and see the parade in person. It’s not an exaggeration to say that this is the biggest and most extravagant parade in the U.S. There are millions of people who come to New York to see it in person.

🏈 NFL Football Games 🏈

Football is one of America’s icons, as well as being a must-have factor of Thanksgiving. On this day, the NFL will continuously have games between different teams in the league. Families in the U.S. will gather together to watch these games. Not just NFL, but high school and college teams also tend to have games during this 4-days weekend.

💸 Big sales on Black Friday 💸

After eating such a huge amount of food, shopping to get rid of those extra calories is a must! Black Friday happens the day after Thanksgiving. This is when most stores in the U.S. would offer big sale offers that would not be available any other time of the year. Years ago, Black Friday used to start in the morning of Friday after Thanksgiving, but due to increasing demands, stores began to start their Black Friday sales the night of Thanksgiving day. Many Americans will start lining up in front of the stores after their Thanksgiving meals in order to get their hands on the things they want.

🦃 Thanksgiving Turkey Presidential Pardon 🦃

This began with Former President Ronald Reagan when he decided to send his turkey to a farm to get raised instead of cooking it for Thanksgiving. It officially became a tradition after Former President George H W Bush pardoned the turkey to push for animal rights. The current President can pardon one to two turkeys every Thanksgiving.

The “candidates” are prepared for this ceremony since they are very young, so they are used to crowds, lights and can comfortably stand on the table during the ceremony. These two “candidates” will “fight” to get pardon through a quick polling on the White House website. The winner will get pardoned by the President. After the ceremony, these turkeys will get to “retired” and nothing will happen to both the winner and loser.

ARCFE's main office is located in Long Island City (LIC), a rising area of New York. Let us give you a brief introduction to LIC.

Long Island City (LIC) is a neighborhood found at the western tip of Queens, and is one of NYC’s fastest growing neighborhoods. It is famous for its waterfront parks and art communities. While it may sounds like LIC (Queens) is far from the heart of NYC, Manhattan, it's actually only 3 miles away by subway.

Not only that it is cheaper to live in LIC compared to Manhattan, but the crime rate is also lower. Living in LIC is a great option if you don't like the busy and crowded Manhattan, but you still want to live close enough so the commute isn't so bad. 📌 CASE: ZHANG V. USCIS 📌

"Zhang and Hagiwara filed and won a lawsuit against USCIS after being rejected from the EB-5 program, leading to USCIS having to reshape its guidelines regarding loans for EB-5 investments."

USCIS has maintained strict guidelines for the EB-5 investment funds. One of these guidelines requires that investors prove their loans were secured by personal assets. The Zhang v. USCIS case is reshaping the guidelines for EB-5 investments. These changes may create more opportunities for EB-5 investors, especially those who are struggling to meet the minimum investment amount requirement.

The case went all the way back to 2013 when Zhang and Hagiwara invested $500,000 USD each into a NCE. The funds were borrowed from their own businesses. The investors have planned to meet the EB-5 eligibility requirements.

However in 2015, USCIS adopted a new policy that focuses on “cash” and “indebtedness” in the approval of EB-5 investment funds. USCIS determined that cash results from loan (garnered through a third party) is indebtedness. This would then require collateralization through investor-own assets. In other words, Zhang and Hagiwara’s petitions were denied because their investment was from uncollateralized loans. This led to Zhang and Hagiwara deciding to file a lawsuit against the USCIS.

The filing first went to a district court in November 2018, and Zhang won the case then. However, USCIS filed for an appeal and the case then transferred to the District of Columbia U.S. Court of Appeals.

In 2020, Zhang won the case once again and the Court ruled that USCIS had wrongly impose collateralization demands on loans EB-5 investment. USCIS’s interpretation had violated the plain meaning of EB-5 regulations. The court explained that cash is fungible and it passed from buyers to sellers, without imposing any buyer’s obligations to his own creditors to the seller.

It was determined that loan proceeds are “cash” and qualify as capital. Uncollateralized loans are classified as a legitimate source of funds for EB-5 investments. This is a victory for EB-5 investors. And this established an important precedent for EB-5 investors.

USCIS approved Zhang’s petition on April 14, 2021. Although unsecured loans in EB-5 is still unclear, the ruling suggests that these types of loans may eventually become eligible for regular use in EB-5 investment. Investors who are considering this option should consult with a lawyer before investing in an NCE, considering that the majority of the USCIS guidelines for EB-5 still remain in effective for all investors.

🔴 EB-5 UPDATES 🔴

- Proposed legislation has been sent to Congress. Industry leaders are striving for the program to be permanent. But even if it can’t be permanent, we hope it can be extended for a long term (5 to 10 years).
- The whole industry is aligned on wanting the program to be reauthorized.
- Now we are waiting for Congress to put our legislation on to the “must pass legislation”. We think it’s going to be mid-October or December.

♦️ Grandfathering ♦️
- Grandfathering states that USCIS will continue processing cases without regard to the program being expired. So that means if you file on, before or after the enactment of this new legislation, it will continue being processed.

♦️ Investment amount ♦️
- TEA projects investment amount is projected to be around $700,000.
- Non-TEA projects investment amount is projected to be around $850,000.
- TEA definition updates to come.

♦️ Advanced parole ♦️
- For investors to land in the U.S. on a temporary visa, before they get conditional green cards, this will help investors from countries that have retrogression issues.
- The temporary visas will allow investors and their families to live, work and study in the U.S. just as if they are green card holders.

♦️ Visa amount ♦️
- The proposed policy will change from 10,000 visas per year (including investors' families) to 10,000 applications or families per year.
- This change may or may not happen depending upon Congress’s consideration.

♦️ Expedited processing ♦️
- Expedited processing will be available for additional fees.
