May was a busy month at the Ashland Home2 Suites by Hilton site. Work moved forward on the slab outside of the existing structure, as well as electrical and plumbing work throughout much of the existing structure. The project, which is being developed by Witness Investment, qualifies for both the rural and high unemployment EB-5 set-aside categories.

When the Sun returns to Atlantic City, guests at the Seahaus Hotel, part of the Tribute by Marriott collection, will be able to take advantage of the hotel’s new deck with an ocean view. Developed by Newcrestimage, this EB-5 hospitality project, is the only nongaming full-service hotel on the famed Atlantic City Boardwalk.

United States Citizenship and Immigration Services (USCIS) released a new policy memo this morning stating that it will only grant “Adjustment of Status” in extraordinary circumstances. Adjustment of Status allows individuals who are in the U.S. on a valid visa to switch their status to another visa category by filing an application (I-485), rather than having to return to their country of birth to go through consular processing.

For EB-5 purposes, adjustment of status through concurrent filing has been a popular option for foreign students and H-1B workers. This is a developing situation with details still emerging and there will most likely be legal challenges to the new USCIS policy memo.
