Your will does not control your 401k.

Retirement accounts and life insurance pass by beneficiary form. That form is a contract with the company holding the money. It does not read your will and it does not lose to it.

So the line in your will leaving everything to your spouse does nothing to the account where you named your mother in 2011.

Log in. Read the name out loud. If it surprises you, that is the point.

Your family makes forty decisions in week one.

Burial or cremation. Whether you wanted a service. Who gets told first. What happens to the dog. Which account pays for any of it.

You know all those answers. Nobody else does.

Families do not usually come apart over money. They come apart over guessing, at the worst week of their lives.

The fix is a plain letter. No lawyer. An hour on a Sunday. Then tell someone it exists.

Estate planning sounds like something rich people do. That is the myth, and it costs regular families the most.

An estate plan is just instructions. Who raises your kids. Who makes the medical call if you cannot speak. Who is allowed into your accounts.

There is no dollar minimum on any of that. You already have an estate. It is your car, your checking account, and a phone nobody else can unlock.

The question is whether your people will know what you wanted, or have to guess.

If something happened tonight, who picks up your kids?

Legally. By name, in a document a judge will actually read.

Without a named guardian, a judge decides, and the judge has never met your children. They hear from whoever shows up. Meanwhile your kids are in a relative's spare room while the adults argue.

Naming a guardian takes an evening. Pick someone, name a backup, and tell them before you write it down.

The hard part is not the paperwork. It is agreeing on who.

The divorce is final. The life insurance still says her name.

The decree splits the assets. What it does not do is call your insurance company or your 401k provider. Those companies pay whoever is on the form.

Some states revoke an ex-spouse automatically, but that protection does not reach employer plans, which is where most people's biggest account lives.

One afternoon fixes it. Read every name. Then confirm the change actually went through.

Your family cannot get into your phone.

They will lock it trying, then end up on a support line explaining that you died and asking a stranger for help. Usually the answer is no.

Behind that lock is the bank app, the email every password reset runs through, and every photo since 2014.

Apple, Google, and Facebook all let you name someone in advance. A few minutes each. Almost nobody has done it.

Elvis left his daughter Graceland and a cash problem.

In 1977 the estate had the house, the name, and not much else. Taxes were eating it. The trustees opened it to the public in 1982 and it earned back the cost of opening within about a month.

That call was made by the people managing the trust, not the person who inherited.

Everyone thinks about who inherits. Almost nobody thinks about who manages. Pick the one who returns phone calls and can say no.

Twenty-six is not too young. It is early enough to be cheap.

By then most people have a 401k with a beneficiary form nobody has touched since orientation, a car, and a partner who is not a spouse and has no legal standing anywhere.

That beneficiary form is the one that catches people. Whoever you wrote down at twenty-two gets the money. Not who your will says. The form wins.

Update it this week. Fifteen minutes.

James Brown had a will. It still took fifteen years.

He died in 2006 with a signed document and a clear plan. Most of the estate was meant to fund scholarships for poor children in South Carolina and Georgia.

His children challenged it. A woman claimed to be his widow. It reached the state Supreme Court and did not settle until 2021. Fifteen years of legal fees came out of the scholarship money.

A will is a starting position, not a shield.

You know where all your accounts are. That is exactly the problem.

The 401k from two jobs ago. The old HSA. The life insurance through work that only pays out if somebody knows to file. Your family does not inherit your memory. They inherit a filing cabinet and a lot of guessing.

One page fixes most of it. What you have, where it is, who to call.

Write it down this week.
