Led by John Markman, NMLS #1660491, The Markman Mortgage Team at Fairway Independent Mortgage serves the Kansas City Metro with a client centric approach to lending. Then changed careers before coming back into the Mortgage Business in 2017 and I've been originating since.

🏠 Qualified Mortgage (QM)
Meets CFPB rules under the Ability-to-Repay (ATR) standard.

No risky features:

No negative amortization (where loan balance grows over time).

No interest-only payments.

No balloon payments (with small-lender exceptions).

Debt-to-Income (DTI) limits: Often capped at 43% (though some QM types allow more flexibility based on pricing).

Upfront fees and points: Generally can’t exceed 3% of the loan amount.

Standard documentation: Requires full verification of income, assets, employment, debts, and credit.

Legal protections for lenders: Safe harbor or rebuttable presumption against borrower lawsuits.

âś… Examples: Conventional loans under Fannie Mae/Freddie Mac rules, FHA/VA loans, USDA loans.

🏠 Non-Qualified Mortgage (Non-QM)
Does not meet all CFPB QM standards, but still must follow the ATR rule.

Allows more flexible terms:

Can include interest-only or balloon payments.

May allow higher DTI (above 43%).

May use alternative income documentation (like bank statements, asset depletion, or stated income for self-employed borrowers).

Higher risk, higher cost: Lenders and investors charge higher rates to account for more risk.

Fewer legal protections for lenders: If the borrower defaults, they can more easily challenge the loan’s affordability in court.

âś… Examples: Bank statement loans, investor cash-flow loans (DSCR), loans for borrowers with recent credit events (like bankruptcy or foreclosure), jumbo loans outside agency guidelines.

Non‑qualified mortgages are gaining ground as self‑employed, investor and foreign‑national borrowers seek flexible financing. See how non‑QM loans could hit 30% of non‑agency MBS in 2025 and how originators can capitalize with bank‑statement, DSCR and asset‑depletion programs.
