Although definitely good news for property owners in flood zones, If you think the worst is over for insurance companies and our current insurance crises in California you would be wrong.

Under the doctrine, the efficient proximate cause of the loss is the one that sets the other causes in motion that in an unbroken sequence produces the damage.

The fire caused the burn scar which allowed rainfall to create the type of mudslides we saw in Jan 2018 in Montecito, California.

Fire was the efficient proximate cause of the mudslides, therefore FIRE is the covered peril, not Flood, which is an excluded peril in Homeowner policies. All damage is covered under the FIRE peril.

This should not be confused with the “Concurrent Causation Doctrine,” where separate excluded and covered causes (perils) simultaneously join to produce damage. An Example is FIRE following an Earthquake. Fire damage is covered, the excluded earthquake damage is not covered.

California courts have established that a prior wildfire "may" be the efficient proximate cause of a landslide. This is not a guarantee, but is a likely outcome in the Palisades Fire for those homes not previously burned or partially damaged ... even those burned that could be buried under mud, any property in mountain areas prone to flooding.

Think about this as well... Most burn areas will be prone to this activity for at least two years, possibly more .... this means not only do insurance companies not want to cover homes in wildfire zones, but also in preburn communities, where they are exposed to flood damage under the FIRE peril.

This is obscene, it was predictable and in fact I did several times over the last 5 years, the failure of the CA fair plan is a direct result of Californias Department of Insurance's Commissioner Lara and Gov Gavin Newsom own failures to act in the best interest of the people of California.
