Nelson Burgos - Beat a 2 Year Old Boy Unconscious With a Belt, R***d and Sodomized Him, and Killed Him - Released From Prison Two Years Ago

On July 13th, 1980, at about 9:30 in the morning, Nelson Burgos used his belt along with his hands and fists to beat a 2 year old boy into unconsciousness. While the child lay unconscious, Burgos, then 24 years old, sodomized and r***d him.
By his own statement, he beat the child because the boy had soiled his pants. He was babysitting him along with his own two children. His wife and the child's mother were at the laundromat.
Afterward, he cleaned the child up, wrapped him in a blanket, and placed him, still unconscious, on the kitchen floor so he would not be seen by anyone who came to the door.
When the two women returned around noon, he tried and failed to revive the boy. Before taking him to the hospital, he worked out a cover story with the child's mother, claiming the boy had been kidnapped by two unidentified men while she was out walking and returned to him with his injuries.
The child spent eleven days on life support. He died on July 24th, 1980 of multiple intracranial hemorrhages caused by the beating.
Nelson Burgos had been charged with assault. The day after the child died, he was indicted for murder in the second degree, manslaughter in the first degree, and two counts of so**my in the first degree. He pleaded guilty on December 23rd, 1980 in Albany County Court before Judge Clyne to murder in the second degree and so**my in the first degree.
State corrections records list both convictions and records his sentence as 25 years to life, with an aggregate maximum expiration of life in prison. His DCJS file lists the sentence as 100 months to 25 years.
He was received into state custody on December 23rd, 1980 and became parole eligible on July 10th, 2005. Corrections records list a second admission date of May 18th, 2007, indicating he was released and returned to custody - likely as the result of a parole violation.
He was released again on September 5th, 2024 from Marcy Correctional Facility. He has been in the community two years. He remains on parole supervision for life.

He is 70 years old and uses a cane.
