If you work in clinical research — as an investigator, coordinator, or research associate — your professional liability exposure doesn't stop when the patient visit ends.

Informed consent issues, documentation gaps, protocol deviations, oversight questions: any of these can lead to allegations that require a legal response, even when no harm was intended.

And the coverage your employer provides may not be enough to fully protect you as an individual.

Today we are walking through where liability shows up in clinical research, what a strong risk management strategy looks like, and how to make sure your coverage actually reflects the work you do. Worth a read if you're in the field.

Your professional liability policy may not cover clinical research. Learn where liability risk shows up for investigators, CRCs, and CRAs — and how to protect your career with the right coverage.

NPs — your state's scope of practice laws directly affect your liability exposure. Here's what to know.

Full practice authority, collaborative agreements, supervision requirements — they're not just regulatory language. They determine what you can do, who is responsible when something goes wrong, and whether your malpractice policy actually covers it.

Three things every nurse practitioner should ask about their coverage:

✔ Does my policy cover all procedures I'm now authorized to perform?
✔ If I practice in multiple states, am I covered in each one?
✔ Does my collaborative agreement affect how a claim against me is handled?

If you're not sure, we can help you find out — no pressure, no jargon.

At most insurance companies, getting a human on the phone is the hardest part.

At CM&F, it's just how we work.

Our team understands professional liability from the inside — the questions NPs have when they take on their first independent patient load, the concerns PAs have when changing practice settings, the situations mental health counselors face that a standard insurance rep wouldn't know how to handle.

We've been picking up the phone for healthcare professionals since 1919. That's not a small thing when a claim is filed and you need someone who actually knows what they're talking about.

What is tail coverage, and why does it matter when you leave your job?

If you have a claims made policy, which many employer sponsored policies are, your coverage generally applies to incidents that both occurred and were reported while the policy was active.

Your old policy has ended. Your new employer’s policy does not cover incidents that happened before you started working there.

Without tail coverage, you could be left without coverage for that claim.

So, what is tail coverage?

Tail coverage allows you to report claims after your policy ends for incidents that occurred while your policy was active.

It can help close the gap between when an incident happens and when a claim is filed, which in malpractice cases can sometimes be months or even years later.

A few things to know:

• Tail coverage is not automatic. You may need to purchase it or negotiate it as part of your employment contract.

• Not every policy requires tail coverage. Some individual occurrence based policies provide coverage based on when the incident happened rather than when the claim is reported.

• Your coverage matters when your job changes. Changing employers, retiring, or moving to part time work can all be good times to review your policy.

CM&F can help you understand how your coverage works and what options may make sense for your situation.

If you’re changing jobs, retiring, or going part time, talk to us before your current coverage lapses.
