Another Lovell Safety Workers' Compensation Claim Win!

Fact Pattern: A claimant initially filed against three roofing companies before later alleging he worked for our insured.

Through a thorough investigation, the Lovell Safety Management team uncovered the key facts: our insured had never heard of the claimant and had no involvement at the alleged job site. By building the factual record early, we established there was no employment relationship and no connection to the claim.

Result: Complete defense victory.

Takeaway: All too often, claims like these can gain traction if the facts aren't challenged early. A proactive investigation can be the difference between a swift dismissal and unnecessary exposure.

Fraud Alert: When the facts warrant a closer look.

A claimant alleged a left ankle injury rendered him totally disabled. At medical examinations, he presented in a CAM boot with crutches and a cane and claimed he was unable to perform ordinary activities, including decorating for Christmas.

Lovell Safety Management Co. LLC identified the credibility concerns and directed a focused claims strategy. Surveillance later captured the claimant decorating for Christmas without any of the assistive devices.

The Workers’ Compensation Law Judge found fraud. The Board Panel affirmed. Effective claims management means recognizing red flags, testing the facts, and developing the evidence necessary to protect the claim.

Another Lovell Claims Win!

Through focused claims management, strategic oversight, and early identification of key medical and legal issues, the Lovell team helped drive a significantly more favorable permanency outcome.

The case involved substantially differing Schedule Loss of Use (SLU) opinions, with our approach focused on compliance with the applicable Impairment Guidelines. After the parties waived depositions, the Board adopted the IME findings and rejected the significantly higher SLU opinions advanced by the claimant.
Where others might simply stipulate to avoid the fight or over-litigate by pursuing unnecessary depositions, we focused on the evidence, identified the key issue, and pursued the most efficient path to the right outcome.

Win Alert: Additional Neck, Back, and Orthopedic Injury Claims Disallowed

Lovell Safety Management Co. LLC recently helped secure another favorable workers' compensation outcome after a claimant sought to expand an accepted bilateral hand rash claim to include alleged orthopedic injuries. Notably, these additional body parts were raised only after the claimant became a no call/no show following the date of accident.

Lovell developed the investigation and litigation strategy, recommending that the defense focus on the mechanism of injury rather than pursuing an IME. Lovell also identified and secured a key employer witness whose testimony supported the defense position.

As a result, the Workers' Compensation Board disallowed the additional body parts. The Board Panel subsequently upheld the decision on appeal, and the claimant's application for Full Board Review was denied.

Estimated savings for Safety Group members: $250,000.

This outcome demonstrates the value of strategic investigation, witness development, and proactive claims management in successfully defending questionable claims for additional sites of injury and controlling claim exposure.
