Win Alert: Additional Neck, Back, and Orthopedic Injury Claims Disallowed
Lovell Safety Management Co. LLC recently helped secure another favorable workers' compensation outcome after a claimant sought to expand an accepted bilateral hand rash claim to include alleged orthopedic injuries. Notably, these additional body parts were raised only after the claimant became a no call/no show following the date of accident.
Lovell developed the investigation and litigation strategy, recommending that the defense focus on the mechanism of injury rather than pursuing an IME. Lovell also identified and secured a key employer witness whose testimony supported the defense position.
As a result, the Workers' Compensation Board disallowed the additional body parts. The Board Panel subsequently upheld the decision on appeal, and the claimant's application for Full Board Review was denied.
