There are two dates every EB-5 investor should know: September 30, 2026 and September 30, 2027.

The program doesn't expire until 2027. But the deadline that actually matters to your petition is a full year earlier.

In 2025, more than 470,000 H-1B registrations competed for 85,000 available slots.

A new weighted wage rule now gives higher-paid applicants a greater chance of selection, reducing odds further for everyone else. A presidential proclamation introduced a $100,000 fee for petitions filed on behalf of beneficiaries outside the U.S. And H-4 spousal work authorization still requires an approved I-140, which takes a minimum of two years and requires employer willingness to sponsor.

These are not edge cases. They are structural features of a category that was never designed to provide permanent status.

The H-1B is a useful tool. But relying on it exclusively is a risk that more and more professionals are no longer willing to take.

Our new series examines how EB-5 and concurrent filing give H-1B professionals an independent path to permanent residency that does not depend on a lottery, an employer, or any single variable staying constant.

CanAm was in Miami last week for the fifth annual JTC x Saul Ewing Advanced EB-5 Conference, and the discussion reflected the weight of the current moment in EB-5.

Christine Chen (COO) and Peter Calabrese (CEO, CanAm Investor Services) joined leading practitioners for a full-day program on the legal, regulatory, and policy developments defining the road ahead.

Three themes stood out:
- The recent USCIS guidance memo limiting Adjustment of Status adjudication is not EB-5-specific. Approvals are continuing, legal challenges are being prepared to affirm the EB-5 carve-out, and pending applicants should be ready for RFEs on consular processing eligibility.
- AI is increasingly shaping how prospective investors research EB-5 and how USCIS manages its workload, but it cannot substitute for the rigorous due diligence that comes from direct, transparent dialogue with a regional center.
- Demand for rural projects remains elevated following the USCIS inventory management memo, though the volume of already-filed petitions significantly exceeds available set-aside visas, pointing to earlier-than-expected retrogression for China and India in that category.

Most EB-5 investors check the Visa Bulletin every month. Very few know how to read it.

There’s a specific sequence of signals that precedes any final action date for reserved EB-5 categories — and if you know what to look for, you won’t be caught off guard.

Charlie Oppenheim, who spent 23 years controlling the Visa Bulletin at the U.S. Department of State, broke it down at the 2026 IIUSA EB-5 Industry Forum:

• Chart A is the hard cutoff. Your priority date must be before Chart A for final action to proceed.
• Chart B reflects where the State Department expects dates to be at year-end. It moves before Chart A does.
• The note section is the earliest warning signal. A note must appear 1–2 months before any date is imposed. No note in May 2026 = no date in June or likely July.
The full sequence: note in bulletin → Chart B date → Chart A final action date. None of these have appeared for rural, HUA, or infrastructure categories as of now.

Last week, USCIS issued a policy memorandum on that has raised questions across the immigration community about the future of Adjustment of Status filings. We want to make sure our investors and partners have a clear picture of what it means, what remains uncertain, and what practical steps to keep in mind.

A few key points:
- The underlying statutes governing EB-5 eligibility and AOS have not changed.
- USCIS has not suspended or terminated AOS processing for EB-5 applicants.
- EB-5 investors who have maintained lawful status are generally viewed as being in a stronger legal position than many other applicant groups.
- Meaningful uncertainty remains, and we are monitoring developments closely.
